ELF intervenes in ‘monster’ supreme court case

By Elf

This case is a monster, let us not hide from the levels of complexity this case raises” - Counsel for MSCCL

ELF recently intervened in a highly technical Supreme Court case that required a tremendous amount of hard work and expertise to navigate. The case centres around the question of water and sewage undertakers’ rights to discharge sewage in this case specifically, into the Manchester Ship Canal and the private rights of the owners of the canal who are impacted.

”There is currently an indisputable societal problem arising from the actual or potential pollution of water bodies up and down the country, a problem which can be contrasted starkly with the information as to profits achieved and dividends extracted by the water companies over the last decade” - Counsel for MSCCL

Our legal team, including members from Hausfeld, Blackstone Chambers, and Stephen Hockman KC of 6 Pump Court played an indispensable role throughout this process. Their expertise, dedication, and tireless efforts were much appreciated. We owe them, along with our supporters, The Good Law Project, a debt of gratitude for their invaluable contributions. Their commitment was essential in obtaining the Supreme Court’s permission to allow ELF’s intervention into this important and strategic case. The court could have refused. As it happened, the Supreme Court decided that ELF had credible and important evidence from the communities we work with who are impacted by sewage pollution. That the evidence should be heard and it was in the public interest to do so.

The Supreme Court will now deliberate on the case, and a decision is expected in the coming months. To everyone involved in this effort, ELF wants to say thank you for your hard work, dedication, and commitment to excellence. This was a true team effort, and we are honored to work alongside such talented and capable colleagues.

Well done, everyone!
